FY2022 H-1B Cap Initial Registration Period Opens on March 9, 2021

USCIS has announced that the registration period for the FY2022 H-1B Electronic Registration will be open from March 9, 2021, to March 25, 2021.  The USCIS will continue to use a random selection process for this year’s H-1B lottery instead of the proposed wage-based selection process.  The DHS published a final rule delaying the effective date of the wage-based selection system for the H-1B cap-subject petitions until December 31, 2021.     The registration process timeline is as follows:   REGISTRATION TIMELINE March 9, 2021:  H-1B registration window opens at 12.00 PM, Eastern Time March 25, 2021: H-1B registration window closes at 12.00 PM, Eastern Time. SELECTION TIMELINE March 31, 2021: USCIS intends to notify selected registrants via USCIS online account. H-1B FILING TIMELINE April 1, 2021: The H-1B CAP subject petition filing date. USCIS would accept selected petitions for 90 days. Prospective petitioners (also known as registrants) must use a “registrant” account within myUSCIS to submit registrations.  Registrants will not be able to add additional information after they select “I am an H-1B registrant” account type until the initial registration period opens. Registrants submitting their own registrations will enter their company information as part of their first H-1B registration. Registrants working with a representative will review the company information that the representative enters. Please see the video below for instructions about setting up registrant accounts. The H-1B registration opens and closes at noon and not midnight.  Many employers lost the opportunity in the previous year as they mistakenly assumed the registration closes at midnight. If you are registering for advanced degree exemption (Master’s cap), make sure that the Beneficiary is eligible for the advanced degree cap.  Once registered under the Master’s cap, the H-1B petition will be denied if filed under the general quota. To qualify for the Master’s cap,  the Master’s or the higher degree must be earned from an accredited institution, and the institution should also be public or non-profit in nature.
